On December 21, 2015, the U.S. District Court of the District of Columbia ruled that rebar tie wire and other miscellaneous steel products on Federal-aid construction projects must meet Buy American requirements according to the Surface Transportation Act of 1982 and subsequent Federal Highway Administration (FHWA) rules. Judge Amit P. Mehta issued a decision for summary judgement in favor of plaintiffs challenging an FHWA memorandum from December 21, 2012 that waived Buy America requirements for miscellaneous steel or iron components.
The FHWA has vacated the original 2012 memorandum and informed its Division Administrators as of January 6, 2016.
